How do you successfully appeal a penalty charge notice? ›

You have 28 days to make a formal challenge (called a 'representation') after you get a notice to owner. You must: explain your reasons for challenging the PCN in as much detail as possible. provide copies of any evidence or documents to support your challenge.

You should lodge the notice of appeal together with a statutory declaration of service with the District Court Clerk in the court area where the decision was made within 14 days of the date of the decision. If the judge orders that money be lodged with the appeal you must lodge the money with the appeal documents.

If you have received an FPN your only right of appeal is in a court. If you receive an FPN you have two options available: Pay the FPN within the timeframe stated on the notice; or. Allow the FPN to lapse and await a court summons.
