Car is 13 years old, can't register in current condition, and has a major component showing signs of failure? Time to replace for safety if nothing else. Does this car have driver and passenger airbags and antilock brakes? If not, there would be my justification right there.

Almost anything new will be more safe and even though it's a honda that V6 isn't that economical to run.

If you hadn't mentioned the transmission, I'd be more likely just to do the maintenance, but the transmission kills the deal as far as I'm concerned. Also, if you have a bad egr, what other items are lurking? Timing belts, brakes, tires, ac, suspension? If any of that stuff is pending or overdue, might as well go ahead and consider that cost.

In terms of passing smog, was the car thoroughly warmed up before you took it in? Like driven around for 1/2 hour and really up to temp? It can make a difference in the numbers.

The car has airbags but things from 13 years ago changes, my car is also older and know that the saftey of a newer car is better than a older car (in most cases). I haven't considered the idea of letting the car warm up first, that's a possible idea if the car was not failing by a great amount.
